Terms & Conditions of Mevidual Group GmbH

Effective: May 2025

1. About Us

1.1 These Terms & Conditions apply to all contracts concluded between Mevidual Group GmbH, Nassaustraße 28, 65719 Hofheim am Taunus, Germany (HRB 113244), and the customer. They govern the contractual relationship between the parties—certain provisions remain effective even after termination of the contract.

1.2 Unless otherwise agreed in writing, all deliveries are subject exclusively to these Terms & Conditions.

2. Orders & Delivery

2.1 Orders are placed via a registered customer account. Users select the mevidual synthor and any desired additional products and complete the checkout on the Amazon payment page (www.amazon.com).

2.2 Delivery is carried out by Amazon. The valid Amazon delivery terms at the time of contract conclusion apply.

2.3 Mevidual shall not be liable for delivery delays caused by Amazon. In case of delay, the customer may cancel the agreement in accordance with Amazon’s terms. Claims for damages are only possible if Mevidual is proven to be at fault, and are limited to the order value, excluding indirect damages such as lost profits.

2.4 In the case of partial deliveries, each delivery is treated as an individual contract. Deficiencies in one delivery do not justify the cancellation of the entire contract.

2.5 Mevidual reserves the right to reject, cancel, or terminate any order at any time, e.g., in case of payment disputes, suspected fraud, or violations of usage policies.

3. Prices, Taxes & Shipping Costs

3.1 Mevidual reserves the right to change prices and shipping costs at any time. The price shown at the time of order confirmation via Amazon is binding.

3.2 All applicable shipping costs and taxes are disclosed before order completion. These may vary depending on the delivery location.

3.3 Legal changes between the order and its confirmation may require tax adjustments. In such cases, the customer will be contacted and asked to reconfirm the purchase.

3.4 The prices per product quantity shown in the app are for informational purposes only and reflect estimated production costs based on current raw material prices. These prices are not binding. Only the actual purchase price in the Amazon store at the time of checkout is binding. Mevidual strives to provide accurate and up-to-date production cost estimates.

4. Product Recommendations & Modifications

4.1 Personalized product recommendations may result in additional costs to be borne by the user.

4.2 Individually selected and processed products are excluded from returns, unless they are prepackaged.

4.3 Changes to product specifications may extend delivery time.

5. Returns & Refusal of Acceptance

5.1 Returns are handled in accordance with Amazon’s return policy. Return shipping is at the customer's own risk and expense.

5.2 Products must be returned unused, in their original packaging, and with all accessories. Opened or used ingredients are excluded from the right of return, as permitted by law (§ 312g BGB).

5.3 Amazon and Mevidual will inspect returns and issue refunds or replacements where appropriate.

5.4 If delivery is not accepted, it is still deemed completed. Resulting costs shall be borne by the customer.

6. Payment Terms

6.1 Payments are made in advance via Amazon. Partial payments are possible, non-refundable, and due immediately. Statutory rights of withdrawal remain unaffected.

6.2 Overdue payments will incur interest of 1.5% per month started, beginning from the due date.

7. Intellectual Property

7.1 All content, trademarks, and designs on Mevidual platforms are protected by copyright or are licensed. Any unauthorized use is prohibited.

7.2 It is forbidden to use information, software, APIs, or services for unlawful purposes or to bypass security mechanisms.

8. Product Liability

8.1 Mevidual is only liable for defects in the synthor that are present at the time of delivery.

8.2 Mevidual accepts no responsibility for issues with raw materials sourced via Amazon.

8.3 Mevidual is not liable for damages resulting from improper storage, usage, or modification by the user.

8.4 The synthor is not intended for commercial use. Non-private use is prohibited.

8.5 Mevidual is not liable for indirect damages or loss of profit, unless caused by intent or gross negligence.

8.6 The customer agrees to indemnify Mevidual from third-party claims, to the extent that Mevidual’s liability is limited.

8.7 If either party is subject to third-party claims, the other must be informed without delay.

9. Disclaimer of Liability

9.1 Mevidual is not liable for damages resulting from:
(a) faulty activation or integration,
(b) user error or misoperation,
(c) incorrect placement or coupling,
(d) third-party interference (e.g., pets, family members),
(e) use of third-party products. Use of such products is at the user’s own risk.

10. Cosmetic Regulation Disclaimer

10.1 The provided products and services are not considered finished cosmetic products under Regulation (EC) No. 1223/2009 or chemicals under REACH. The user is solely responsible for safe storage, handling, and application.

10.2 The user agrees to follow all safety instructions for the ingredients. Mevidual is not liable for any damages resulting from improper or negligent use.

10.3 Product recommendations are based on user-provided data and are intended as guidance only. The final decision and application are the user's responsibility. In case of known skin issues, users are advised to consult a medical professional prior to use.

10.4 Before each mixing process, the user confirms:

“I understand that I am personally responsible for mixing and applying this formulation. The recommendation is based on my input.”

11. Data Protection

11.1 Personal data is processed in accordance with the GDPR. See our privacy policy for details.

11.2 Information on skin type, allergies, or skincare behavior is considered special category data under Art. 9 GDPR and is only processed with explicit consent.

12. Final Provisions

12.1 Mevidual may update these Terms & Conditions at any time. Updates become effective after a 14-day notice period.

12.2 If any provision is found to be invalid, the remaining provisions shall remain unaffected.

12.3 These Terms replace all previous agreements.

12.4 Waiving rights in case of one breach does not constitute a waiver for future breaches.

12.5 German law applies, excluding conflict of laws.

12.6 Jurisdiction is Frankfurt am Main or Hofheim am Taunus.
