BETA-TESTER CONDITIONS FOR THE MEVIDUAL BETA PROGRAM

1. Provider and Contractual Partner

These Beta Tester Conditions apply to participation in the beta testing program of mevidual Germany GmbH, Nassaustraße 28, 65719 Hofheim am Taunus, Germany, Email: info@mevidual.com, Phone: (+49) 06127 7064893, hereinafter referred to as "mevidual", "we", "us" or "our".

These Beta Tester Conditions apply in addition to our general terms and conditions, terms of use, privacy policy, safety and usage instructions. In case of contradictions, these Beta Tester Conditions for participation in the Beta Program shall prevail.

Insofar as our general terms and conditions contain provisions regarding purchase, payment, acquisition of ownership, return, refund, Amazon orders or other paid orders, these shall only apply to the Beta Program if expressly referenced in these Beta Tester Conditions. The Beta Program is not a regular purchase process.

2. Subject of the Beta Program

mevidual provides selected participants with a mevidual system within the framework of a temporary beta test. This may include in particular the mevidual Synthor, accessories, documentation, app access, software, firmware, test materials, packaging and, where applicable, consumables.

The purpose of the Beta Program is to test the system under realistic usage conditions, to receive feedback, to implement technical and user-related improvements, and to further develop the usability, stability, security, and functionality of the system.

Participation in the Beta Program does not give rise to any claim to participate in future tests, to permanent use, to acquisition of ownership, to free products after the end of the beta test, or to the availability of certain functions.

3. Eligibility for Participation

Only natural persons who are at least 18 years old and have full legal capacity may participate.

Participation is only possible by invitation from mevidual and using a valid beta link or beta coupon code. The beta link and beta coupon code are personal, non-transferable, and may not be published, sold, passed on, or misused.

mevidual may refuse or terminate participation if there is a justified suspicion that false information has been provided, the beta link or beta coupon code has been misused, no beta devices are available, or these Beta Tester Conditions are being violated.

4. No Purchase, No Gift, No Transfer of Ownership

The device provided within the Beta Program is neither sold nor given away as a gift.

The provision is exclusively a free, temporary loan / hire. Ownership of the device, accessories, and other non-consumable components remains with mevidual Germany GmbH or the respective rightful owner at all times.

Even if a coupon code is used in the online process and a price of 0.00 EUR is displayed, this does not constitute a purchase contract for the device and no transfer of ownership. The coupon code is used exclusively for the technical processing of the free beta provision.

The Beta Tester is not entitled to sell, give away, pledge, rent, lend, pass on, permanently transfer to third parties, or otherwise dispose of the device.

5. Conclusion of the Beta Test Agreement

The Beta Test Agreement is concluded when the Beta Tester accepts these Beta Tester Conditions in the online process, definitively starts the beta test, and mevidual confirms participation or ships the beta device.

Before completing the process, the Beta Tester will be clearly shown that it is a free beta test participation with a return obligation and that no ownership of the device will be transferred.

The use of the beta coupon code does not establish a right to delivery or participation. mevidual may reject a beta order, in particular, if no devices are available, the participation requirements are not met, there is suspicion of misuse, or legal, technical, organizational, or safety-related reasons prevent it.

6. Costs of the Beta Program

For participation in the beta test and the temporary use of the beta device, mevidual does not charge a purchase price or a rental fee.

Unless expressly stated otherwise in individual cases, mevidual bears the costs for shipping the beta device to the beta tester as well as the costs for proper return, if the return method provided by mevidual is used.

However, the beta tester bears costs, damages or losses incurred as a result of violating these beta tester conditions, negligently damaging or losing the device, failing to return it, or not using the return method provided by mevidual.

7. Duration of the Beta Test

The beta test begins with the delivery of the beta device to the beta tester and initially runs for a period of 14 calendar days.

An extension of the beta test phase is only possible after prior consultation with mevidual and requires the express written consent of mevidual Germany GmbH, for example by e-mail. The beta tester has no right to an extension.

Without such express consent, the beta tester's right of use automatically ends after the 14-day beta test phase. Mere continued use of the beta device, a delayed recall by mevidual or mevidual's silence do not count as an extension of the beta test phase.

After the expiration of the beta test phase or an expressly confirmed extension, the beta tester is obliged to return the beta device completely and properly to mevidual without delay, at the latest within 14 calendar days after the end of the beta test phase.

8. Obligation to Return

The beta tester must return the same device that was provided to them. The return of another device or a replacement device is only permitted with the prior written consent of mevidual Germany GmbH.

The following items must be returned:

• the mevidual Synthor,
• supplied accessories,
• power supplies, cables, adapters, and other technical components,
• supplied transport or protective packaging, if still available,
• other non-consumable components that were explicitly designated as returnable.

Consumables, test raw materials, or ingredients that were consumed as intended within the scope of the beta test do not have to be returned, unless mevidual states otherwise.

The device must be returned in a cleaned, carefully packaged, and complete condition. Normal signs of wear from contractual use are permissible.

Damage due to improper use, opening the device, tampering, dropping, liquid damage, unauthorized cleaning methods, unauthorized repair attempts, or use contrary to the operating instructions, safety information, or app notices is not permitted.

9. Non-Return, Delayed Return and Loss

If the beta tester does not return the device in due time after the end of the beta test phase, mevidual may request its return and set a reasonable grace period.

A delayed return or continued use of the beta device after the beta test phase has expired does not constitute an extension of the beta test phase or a further right of use, unless mevidual Germany GmbH has expressly agreed to the extension in text form beforehand.

If the return does not take place even after a reasonable grace period, mevidual can demand surrender, compensation and reimbursement of the incurred damage according to legal provisions. This does not apply if the beta tester is not responsible for the delayed or impossible return.

The claim for compensation may include, in particular, the replacement value, repair costs, depreciation, shipping costs, and reasonable legal prosecution costs.

A payment of damages does not automatically lead to an acquisition of ownership of the device, unless mevidual expressly confirms otherwise in text form.

mevidual may block or restrict app access and associated services if the device is not returned, a security risk exists, or these Beta Tester Conditions are violated.

10. Use of the Beta Device

The beta tester may use the beta device exclusively for private testing purposes and exclusively in accordance with the provided instructions, safety information, app notices, and these Beta Tester Conditions.

The beta tester undertakes in particular to:

• handle the device carefully,
• follow all safety and usage instructions,
• use the device only in a suitable environment,
• keep children and unauthorized third parties away from the device,
• not open, dismantle, modify, or repair the device,
• not use unauthorized components, software, spare parts, or raw materials,
• not perform reverse engineering, manipulation, security circumvention, or stress tests,
• not use the device for commercial production, resale, advertising, affiliate activities, or commercial cosmetic manufacturing,
• not pass on the device to third parties or allow third parties to use it, unless mevidual explicitly permits this in writing.

11. Safety, Defects and Reporting Obligations

The beta tester must immediately cease use and inform mevidual without delay if:

• the device is damaged,
• unusual noises, odors, heat development, or malfunctions occur,
• liquids have entered the device,
• the device has fallen,
• a safety warning is displayed,
• there is suspicion that the device poses a risk,
• personal injury or property damage occurs in connection with the use,
• an allergic reaction, skin irritation, or other unexpected reaction occurs in connection with a manufactured recipe.

The beta tester may not continue to use a defective or safety-relevant device and may not attempt any repairs themselves.

For safety reasons, mevidual may at any time demand that use be discontinued, the device returned, a software update performed, or certain functions deactivated.

12. Beta Character of the System

The Beta Tester is aware that the system is being tested and further developed within the framework of the Beta Program. Functions may be incomplete, changed, deactivated or removed. The availability of the app, individual recipe suggestions, software functions or support services may be limited.

The system may contain errors, limitations or not yet finalized functions. The Beta Tester agrees to use the system with particular care, taking into account this beta character, and to observe mevidual's instructions.

This does not affect mevidual's obligation to provide only a device that can be safely used with proper use and observance of the safety information. Statutory rights, in particular in the event of intent, gross negligence, injury to life, body or health, product liability and mandatory consumer protection regulations, remain unaffected.

13. Ingredients, DIY Production and Cosmetic Notes

mevidual does not sell finished cosmetic products within the framework of the beta program, unless expressly stated otherwise. Recipes, instructions and app recommendations are intended to support private DIY production.

The beta tester is responsible for correctly identifying supplied or self-procured ingredients, storing them properly, dosing them as intended and precisely following the instructions.

Products manufactured with the system are intended exclusively for private, personal use. Passing on, selling or commercially placing the manufactured products on the market is not permitted without full compliance with the applicable legal requirements, in particular cosmetic law regulations.

Every raw material can cause intolerances or allergic reactions. The beta tester should perform a patch test before widespread application and seek expert advice in case of known or suspected intolerances, skin diseases, irritations or medical questions.

The app, recipes, notes and provided information do not replace medical, dermatological or pharmaceutical advice.

14. Beta Tester Feedback

Participation in the Beta Program includes the willingness to provide mevidual with feedback on usage, usability, functionality, stability, recipes, results, packaging, instructions, and overall experience.

The Beta Tester can submit feedback through channels provided by mevidual. Feedback should be truthful, factual, and free of infringing content.

The Beta Tester grants mevidual a temporally, spatially, and content-wise unlimited, gratuitous, transferable, and sublicensable right of use for feedback, suggestions, ideas, bug reports, and improvement suggestions, to the extent necessary to analyze, further develop, improve, market, and commercially exploit the system, app, products, documentation, and services.

This does not apply to personal data, images, videos, names, voice, or testimonials of the Beta Tester for marketing purposes. Commercial use of such personal content will only occur with separate, express consent.

15. Confidentiality

If mevidual makes non-public information, prototypes, pre-release versions, technical documents, unpublished features, internal product information or other information identifiable as confidential available to the beta tester, this information must be treated as confidential.

The beta tester may not publish, post, film, stream, reproduce, disseminate or make such confidential information accessible to third parties without the prior written consent of mevidual Germany GmbH.

Information that is already publicly known, becomes public without a breach of duty or was demonstrably lawfully communicated to the beta tester by third parties is not confidential.

Personal opinions about one's own beta experience are permissible, provided that no confidential information, security details, unpublished functions, personal data of third parties or trade secrets are disclosed.

16. App, Software and Updates

The use of the Beta device may require the installation and use of the mevidual app. For the duration of the Beta Program, the Beta Tester receives a limited, revocable, non-exclusive, non-transferable right to use the app and provided software exclusively in connection with the Beta Test.

mevidual may provide updates, patches, feature changes, or security updates. The Beta Tester undertakes to install security-relevant updates promptly or to cease use if mevidual so requests.

The Beta Tester may not copy, decompile, disassemble, reverse engineer, circumvent, manipulate, or use the app, software, firmware, or interfaces for the development of competing products, unless this is mandatorily permitted by law.

17. Data Protection and Usage Data

mevidual processes personal data of the Beta Tester in accordance with the respective applicable privacy policy and, if applicable, supplementary Beta data protection notices.

Within the framework of the Beta Program, in particular contact data, shipping data, device data, serial numbers, app usage data, technical error reports, feedback content and support communication can be processed.

If special categories of personal data, such as health-related information or information on skin conditions, are to be processed, this will only be done on an appropriate legal basis and, where necessary, with the explicit consent of the Beta Tester.

Der Beta-Tester ist nicht verpflichtet, in Freitextfeldern sensible Informationen, medizinische Diagnosen oder personenbezogene Daten Dritter anzugeben.

18. Sperrung und Beendigung der Teilnahme

mevidual kann die Teilnahme am Beta-Programm aus wichtigem Grund jederzeit beenden. Ein wichtiger Grund liegt insbesondere vor, wenn:

• der Beta-Tester gegen diese Beta-Tester-Bedingungen verstößt,
• das Gerät nicht vertragsgemäß verwendet wird,
• Sicherheitsrisiken bestehen,
• der Beta-Tester falsche Angaben gemacht hat,
• der Beta-Link oder Beta-Coupon-Code missbräuchlich verwendet wurde,
• das Gerät weitergegeben, verkauft, manipuliert oder nicht zurückgegeben wird,
• gesetzliche, regulatorische, technische oder organisatorische Gründe die Fortsetzung unmöglich oder unzumutbar machen.

Mit Beendigung der Teilnahme endet das Nutzungsrecht am Beta-Gerät, an Beta-Funktionen und an nicht öffentlich zugänglichen Beta-Inhalten. Das Gerät ist nach Maßgabe dieser Beta-Tester-Bedingungen zurückzugeben.

19. Haftung von mevidual

mevidual haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, für Vorsatz und grobe Fahrlässigkeit, für Ansprüche nach dem Produkthaftungsgesetz sowie soweit eine Garantie ausdrücklich übernommen wurde.

Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten haftet mevidual der Höhe nach beschränkt auf den vertragstypischen, vorhersehbaren Schaden. Wesentliche Vertragspflichten sind Pflichten, deren Erfüllung die ordnungsgemäße Durchführung der Beta-Test-Vereinbarung überhaupt erst ermöglicht und auf deren Einhaltung der Beta-Tester regelmäßig vertrauen darf.

Im Übrigen ist die Haftung von mevidual ausgeschlossen, soweit gesetzlich zulässig.

Die Haftungsbeschränkungen gelten entsprechend zugunsten der gesetzlichen Vertreter, Mitarbeiter, Erfüllungsgehilfen und verbundenen Unternehmen von mevidual.

20. Haftung des Beta-Testers

Der Beta-Tester haftet gegenüber mevidual nach den gesetzlichen Vorschriften für Schäden, die durch schuldhafte Pflichtverletzungen verursacht werden.

Der Beta-Tester haftet insbesondere für schuldhafte Beschädigung, Verlust, nicht autorisierte Weitergabe, nicht vertragsgemäße Nutzung, Manipulation oder nicht fristgerechte Rückgabe des Beta-Geräts.

Normale Abnutzung durch vertragsgemäßen Gebrauch ist nicht zu ersetzen.

21. Kein Anspruch auf Kaufoption

Ein Anspruch auf Kauf des Beta-Geräts besteht nicht.

mevidual kann nach eigenem Ermessen anbieten, dass der Beta-Tester nach Ende des Beta-Programms ein Gerät kauft, behält oder gegen ein Seriengerät austauscht. Ein solches Angebot bedarf einer gesonderten Vereinbarung.

Ohne ausdrückliche Zustimmung der mevidual Germany GmbH in Textform bleibt es bei der Rückgabepflicht.

22. Änderungen des Beta-Programms

mevidual kann das Beta-Programm, den Testumfang, Funktionen, Zeitpläne, Supportkanäle oder Testanforderungen ändern, soweit dies für die Durchführung, Sicherheit, Weiterentwicklung oder rechtliche Konformität des Beta-Programms erforderlich ist und den Beta-Tester nicht unangemessen benachteiligt.

Über wesentliche Änderungen wird mevidual den Beta-Tester in geeigneter Weise informieren.

23. Kommunikation in Textform

Erklärungen im Rahmen dieser Beta-Tester-Bedingungen, insbesondere Zustimmungen, Verlängerungen, Rückgabeanweisungen, Beendigungen oder Sicherheitsinformationen, können in Textform erfolgen, zum Beispiel per E-Mail.

Für Verlängerungen der Beta-Testphase ist eine ausdrückliche Zustimmung der mevidual Germany GmbH in Textform erforderlich. Mündliche Absprachen, Schweigen oder bloße Weiternutzung des Geräts reichen hierfür nicht aus.

24. Anwendbares Recht

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.

Wenn der Beta-Tester Verbraucher mit gewöhnlichem Aufenthalt in einem Mitgliedstaat der Europäischen Union ist, bleiben zwingende Verbraucherschutzvorschriften dieses Staates unberührt.

25. Schlussbestimmungen

Sollte eine Bestimmung dieser Beta-Tester-Bedingungen unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

Mündliche Nebenabreden bestehen nicht. Individuelle Vereinbarungen gehen diesen Beta-Tester-Bedingungen vor.
